Consultancy
Derek Waller Services hereinafter referred to as DWS, acts only as a marketing agent not as a sales agent for the companies it recommends. Whilst DWS has taken all due care to ensure the companies it recommends are reputable, it has no direct authority to enter into any contract on their behalf and therefore cannot be held responsible for any of their actions. I/We understand that, in instructing DWS-: Designs, measurements and requirements taken on site are cursory only and that the company concerned must carry out a full detailed survey prior to manufacture. The company concerned also has the right to amend these details as they see fit. I/We acknowledge receipt of the above terms and conditions and hereby confirm the appointment of DWS.
The cost of this site visit is set at the time of the appointment and will not vary. The costs are based on £75.00 per hour and .65p per mile for travelling. DWS have the right to amend these rates as they see fit where fuel costs have risen which therefore may not always coincide with the figures shown on this document until a reprint is due. The date at the top of this document confirms the printed date. This site visit (approx 1 hour) will allow the Surveyor to gather all of the information required to enable DWS to go out to tender. Copies of all documents sent to tender will be left with the customer or forwarded at a later date.
DWS work to Building Regulations (whether required or not) and all necessary British / European Standards. Therefore, any changes to the specification must be within these regulations and standards accordingly. With Conservatories, DWS are not able to check base work underground. Therefore, all work must comply with the Guidelines of the installation of Conservatories GGF data Sheet 5.7.7 December 2001. It is the customer’s responsibility to enquire if Planning Permission is required. In the case of new build the customer must check with the builder to ascertain if there are any protected development rights or that there is not a covenant on the land and acquire the neighbour’s permission in writing prior to any work being carried out. This is essential if the structure is to be on or near the boundary line. (Section 1 of the “The Party Wall act 1996”). It is the company’s responsibility to apply for Planning Approval if required on the customers behalf. It is not permissible to break through into the conservatory from the main building without installing doors etc unless planning permission is obtained. A radiator cannot be installed in the Conservatory which is linked to the house boiler/system unless Planning permission has been approved or unless the radiators/s can be controlled from the house. With window replacements, all designs by DWS will incorporate Egress fire hinges where required, Slot/Trickle ventilation as necessary or required and designs agreed on site during the consultation. Any changes to these designs should be confirmed in writing to DWS in case there is a conflict of requirements. DWS cannot be held responsible for the customers or companies failure to comply with any of the above requirements. Dimensions and designs shown on any drawings are approximate and may change when the survey takes place and the Conservatory / Windows are sent for manufacture, therefore do not form any part of the survey.
Advice/Reports

The date at the top of this document confirms the printed date. This site visit (approx 1 hour) is for assessment of the problems only and therefore does not provide any written documentation. However, if there are a small amount of problems that could be resolved by a simple fax/email to the company concerned it will be at the discretion of the Surveyor if this work can be carried out without cost. Should there be a considerable number of faults then the Surveyor may require additional fees for the preparation of this work based upon the hourly rate above. Should a full report be required then the Surveyor will advise of the likely costs involved. The Surveyor has the right to decline from preparing the actual report and may suggest a colleague whom he will send any written details too free of charge. The chosen Surveyor will act independently of DWS and will discuss his costs for the preparation of the report separately. In accepting the terms of business of this Surveyor you relinquish the contract between yourself and DWS.
Complaints
If you are unhappy with the service we have provided a person has been appointed in the office to deal with complaints and you should not hesitate to contact the relevant person should the need arise. Write to the Office Manager C/o Access Space, Harborne Lane, Selly Oak, Birmingham, B29 6SN. Tel 0800 298 5631 where your complaint is made orally, you will be requested to send a written summary of your complaint to the person dealing with it. Once we have received your written summary of the complaint; we will contact you in writing within 7 days to inform you of our understanding of the circumstances leading to your complaint. You will be invited to make any comments that you may have in relation to this. Within 21 days of receipt of your written summary, the person dealing with your complaint will write to you, in order to inform you of the outcome of the investigation into your complaint and to let you know what actions have or will be taken. If you are dissatisfied with any aspect of the handling of your complaint you should contact a nominated person namely John Brookes who will personally conduct a separate review of your complaint and contact you within 14 days to inform you of the conclusion of his review. We will advise you of his contact details should the need arise. If you still remain dissatisfied with any aspect of our handling of your complaint, then we will arrange for you to contact Barry Cross Building Surveyor FCIOB, FRSH, MRICS, MCIH who will personally conduct a separate review of your complaint and contact you within 14 days to inform you of the conclusion of his review. We will advise you of his contact details should the need arise. If you still remain dissatisfied with any aspect of our handling of your complaint, then we will attempt to resolve this promptly through negotiations and otherwise agree to enter into mediation with you in accordance with the Centre for Dispute Resolution (CEDR) Model Mediation Procedure.
